What do I do after a car accident?
If you’ve been involved in a car accident in Los Angeles, the first thing you’ll need to do, if you can, is pull over to safety. Check yourself and your passengers for injuries and call for an ambulance if necessary. Then, contact the police so that they can file an accident report containing details about the accident (be sure to get a copy of this report for your records because it contains valuable information that can be used to strengthen your claim for compensation). Be sure to avoid saying anything that could be construed as an admission of fault for the accident, such as “I’m sorry” or “I didn’t even see you coming.” The insurance company can and will attempt to use this against you to prevent you from recovering compensation.
If you are able, take photos or videos of the scene of the accident, including damage to your vehicle and any visible injuries that you and/or your passengers have sustained. Be sure to get the name and contact information of the other driver involved in the accident, as well as information about their vehicle including make, model, color, and license plate number. If there are any witnesses around, take down their name and contact information as well.
Once you have taken care to receive medical attention, you may be contacted by the other driver’s insurance company. If they ask you to make a statement about the accident, do not do so until you consult a car accident attorney. If they make a settlement offer, politely refuse until you have talked to a lawyer about your case. There is a good chance they aren’t offering you anywhere near what you are owed for your losses, including vehicle repair costs, past and future medical bills, lost wages, and more. As soon as you are able, contact a qualified Los Angeles personal injury attorney to request a free, no-obligation case review to discuss the potential value of your case and what your best legal options are for moving forward.
How do I file a personal injury claim?
If you were injured in an accident that someone else caused, you may have a valid personal injury claim. The first thing you need to do is confirm with an attorney whether your claim has merit. You can do this by contacting a reputable personal injury law firm and requesting a case evaluation. Most personal injury lawyers offer free consultations during which they will review the circumstances of the case, answer questions, and provide advice on how best to proceed. When you retain legal counsel, your attorney can then help you file a claim or lawsuit against the parties liable for your accident.
What does a Los Angeles personal injury attorney cost?
You may be wondering whether you can afford to hire a Los Angeles personal injury lawyer. With contingency fees, this isn’t something you need to worry about. At Adamson Ahdoot, LLP, we front all costs to begin a case and only charge attorney fees if we successfully recover money for our client. If a recovery is not made, we won’t charge for our services. This arrangement eliminates risk and the need to pay an attorney out-of-pocket, as our fees are taken as a portion of the settlement money. Contingency fees allow all people access to an attorney regardless of their financial situation. If you have further questions about how contingency fees work, give us a call at (877) 871-3265.
What is my personal injury case worth?
The value of a personal injury case depends on several elements. Here is a list of some of the things we consider:
- The total amount of your medical bills
- Projected future costs of medical care
- The value of income lost during your recovery
- Whether your injury prevents you from working in the same capacity again
- The value of your vehicle repair/replacement costs
In addition, because California is a comparative negligence state, your percentage of fault for the accident must also be considered. How much of a recovery you are eligible for depends on how a jury apportions fault among those involved in the accident. For example, if a plaintiff’s injuries total $30,000, but he is found to have been 10% at fault for the accident, he may be entitled to $27,000 ($30,000 less 10%).
Because every case is different, it is important to discuss the potential value of your case with an attorney.
Who can I sue for personal injury?
Depending on the type and circumstances of the accident, there are a number of parties you could potentially sue for compensation. For example, if you were injured when you slipped and fell in a store or other establishment, you may be able to sue the owner or manager. If you were hurt while on-the-job at a construction site, you may have a case against a contractor, subcontractor, a negligent employee, or the manufacturer of a defective tool or piece of machinery. Hurt by a dangerous drug, medical device, or household product? The manufacturer may be responsible. Hurt in a bus accident? You may be able to sue the driver, the person or company in charge of maintaining the bus, a municipality, or another driver who caused the accident. It all depends on what happened, who owed a duty of care to whom, and who breached that duty causing your injury. An experienced attorney will be able to investigate your case to determine all of the parties who contributed to and/or caused your accident in pursuit of maximum results.
