Our clients were traveling with the plaintiff eastbound in the #1 lane on Nadeau Street in Huntington Park. The DUI with injury accident occurred as they approached the intersection of Marbrisa Avenue in a stop-and-go traffic condition in Los Angeles County, California.
At the time, the defendant was driving directly behind our client’s vehicle at a high rate of speed. The defendant then attempted to change lanes. However, the defendant failed to yield to the slowing traffic ahead and struck the rear of our client’s vehicle.
Upon impact, one of our clients struck their head against the window of their vehicle, briefly losing consciousness. Another plaintiff struck their head on the front seat of the vehicle, also resulting in a brief loss of consciousness. One of our injured clients was nine weeks pregnant at the time of the collision. The defendant was arrested for driving under the influence.
The police officer at the scene determined that the defendant driver was at fault for the collision. The deputy found that the defendant violated California Vehicle Code Section 23153 (a) VC for causing a traffic accident with personal injury while driving under the influence (DUI) on a Los Angeles street. In addition, the officer found that the defendant driver violated Section 22350 VC for driving at a speed unsafe for the existing roadway and traffic conditions.
