Our clients were passengers of the plaintiff traveling eastbound in lane #1, in stop-and-go traffic on Nadeau Street approaching the intersection of Marbrisa Avenue in Huntington Park, California.
At that time, the defendant operating a different vehicle was traveling directly behind our clients’ vehicle at a high rate of speed and attempted to change lanes. As a result, the defendant failed to yield to the slowing traffic ahead and slammed into the rear of our client’s vehicle.
Upon impact, one of our clients struck their head to the window of his vehicle and lost consciousness for a brief period and our other client struck their head onto the front seat of the vehicle and lost consciousness for a brief period. One of our clients was nine weeks pregnant at the time of the collision. The defendant was arrested for driving under the influence of alcohol.
The police officer on the scene found the defendant driver at fault for the collision in violation of California Vehicle Code Section 23153 (a) VC for proximately causing traffic collision while under the influence of alcohol and 22350 VC for driving at an unsafe speed for existing roadway and traffic conditions.
