$1.5 Million Arbitration Award for Parking Lot Accident
Our client was the restrained driver and passenger of a vehicle traveling eastbound in lane 3 of Pleasant Grove Boulevard in Roseville, California. At the time, the defendant driver was in a vehicle in a parking lot and unexpectedly pulled out, causing an accident. By making such a sharp and sudden turn, our client had no time to react and was involved in a broadside collision with the defendant’s vehicle. As a result, our client struck their head against the vehicle’s window.
The police officer at the scene determined that the defendant driver was at fault for the collision. Specifically, for violating California Vehicle Code Section 21804 (a) by failing to yield when entering a roadway.
As a result of this parking lot accident, our client’s vehicle was totaled. In this case, liability was not in dispute, and the defendant’s insurance company admitted fault.
The plaintiff sought emergency medical care at Sutter Roseville Medical Center for their injuries. They suffered multiple injuries, including neck, shoulder, and upper and lower back pain. These cervical and lumbar injuries required surgery. Additionally, the plaintiff sustained mild traumatic brain injuries, leading to cognitive symptoms such as chronic pain and memory difficulties. To this day, they continue to experience cognitive challenges, limited mobility, and emotional distress due to their injuries.
