Our client was walking into Yogurt Barn in Lakeside, California. Our client opened the door and walked in when they tripped over a broken tile and fell onto the ground, landing on their hip and jolting her neck. Our client sustained severe and debilitating injuries as a result of this incident.
As discussed below, the defendant failed to exercise ordinary care to keep the premises in a reasonably safe condition, actually and proximately causing our client’s resulting injuries.
As a result of the defendant’s negligence, the client suffered injuries such as neck & thoracic back pain. After leaving the Yogurt Barn, our client drove home and went to bed.
The following morning, they went to the emergency department at Sharp Rees-Stealy Medical Group.
At that time, they complained of a squeezing, tension headache, and pain in her neck, right shoulder, and right-sided chest. Physical examination demonstrated spasm, tenderness, and decreased range of motion in her cervical spine. X-rays of her cervical and thoracic spine were taken.
