Our client was the front seat passenger in the defendant’s vehicle operated by an Uber driver traveling southbound on Main Street at the intersection of Choiceana Avenue in Hesperia, California. The driver had stopped the vehicle at the stop sign and then proceeded into the intersection without paying attention to the oncoming traffic. This led another vehicle traveling on Main Street to collide with the passenger’s side of the defendant’s vehicle.

The police officer on the scene found the defendant at fault for the collision in violation of California Vehicle Code Section 21802 (a) for failure to yield to the right-of-way.

Our client saw a doctor at SAC Health System for evaluation and treatment of injuries sustained due to the motor vehicle collision that occurred earlier in the day. They complained of sharp, dull, and burning pain in his neck, and weakness in the upper and lower extremities. Our client reported that the pain in the neck radiated down both arms. They reported weakness in the legs, ataxia, and weakness in the hands. Physical examination demonstrated decreased strength in the upper and lower extremities and decreased sensation in his C5 and C6 dermatomes.
