Our client was a restrained passenger of a vehicle traveling eastbound on SR-12 in Fairfield, California. The defendant was driving northbound on Pennsylvania Avenue at the intersection. They ran the red light and entered the intersection while under the influence of alcohol and crossed over into the client’s path.

Our client’s vehicle entered the intersection upon the green light, had no time to react, and collided with the defendant driver’s vehicle simultaneously along with another vehicle traveling in the same direction as our client. The Police Officer on the scene of the collision found the defendant at fault for the collision in violation of California Violation Code CVC 21452 (a) and 23152 (a) for failing to yield to a red signal and driving under the influence of alcohol.

Our client was seen by the paramedics at the scene of the collision. They complained of pain and pressure in their back. Physical examination revealed diffuse tenderness over the lumbar spine. An X-ray of the lumbar spine revealed a low back strain. Further physical examination revealed tenderness to palpation in his cervical, thoracic, and lumbar spine, as well as a decreased range of motion in their cervical and lumbar spine.

As a result of their injuries, our client was sent to a neurosurgeon for thoracic spine surgery. Their lasting injuries have affected their daily life.
