Bicyclist Dead After One Month Hospitalization for Crash Injury
A male bicyclist, aged 76, who has been hospitalized for a month after a traffic accident in September, dies from his injuries on Tuesday, October 13th. The San Jose Police Department is the main investigator for the case. The accident took place on September 4th, at around 3:14 p.m.
The man was traveling on Blossom Hill Road when he was hit by a white 2013 Mazda CX-7 driven by a woman. She was trying to pass another vehicle to get to the freeway. In her attempt to do this, she struck the man, who was riding his bicycle in the bike lane. The woman was not arrested at the scene for her actions, although San Jose police are in the process of filing their findings to the county prosecutors, who will determine whether criminal charges will be filed against her.
Is There A Time Limit in Pursuing Personal Injury Claims?
Unfortunately, there is indeed a time limit imposed for victims who want to pursue personal injury claims against an at-fault driver. In California, victims have a maximum of two years from the time of the accident to file a claim. After that time period has passed, victims can no longer pursue a claim. Thus, if you were injured in a vehicular crash, it is absolutely crucial to check for any injuries that may cause you possible catastrophic injuries later on. This is important since you cannot change your claim later on if it was already processed. However, you can’t also take your time in choosing when to file your claim. If you’re not sure when you should file your personal injury claim, we provide a free initial legal consultation with one of our lawyers, which is available for you at any time by calling (800) 310-1606.
