Can You File A Personal Injury Claim in an Auto Accident if You Were Not Driving Your Own Vehicle?
Yes, you can. In general, if the owner of the vehicle has auto insurance, and an auto accident happens while you were using it, the owner has vicarious liability – meaning, any injuries, fatalities, or damages incurred from the auto accident will fall into the responsibility of the car owner. Thus, if you were injured while driving a vehicle that isn’t yours, you can submit a personal injury claim to the owner’s auto insurance provider. However, this can only be done if you receive permission from the owner to use their vehicle – stolen vehicles don’t count.
