Can You File Wrongful Death Claims Against An Employee?
Generally, if a victim dies of an automobile accident caused by an employee who was performing their duty at the time of the incident, a wrongful death claim should be filed against the employer. Not the employee. This is especially true in California where employers have vicarious liability for the actions an employee does while working for them. If you’d like to know more on how to file a wrongful death claim against an employee’s employer, call us today at (800) 310-1606 to get a free consultation, available 24/7.
