Can You File A Wrongful Death Claim to Your Deceased’s Auto Insurance Provider?
Unfortunately, no. A wrongful death claim can only be filed against a party who is being held responsible for causing the death of the deceased. Thus, it isn’t possible to pursue this type of claim to your auto insurance provider if your loved one died in a car accident. What you can claim, however, is a death benefit. It is possible to claim this if the deceased was also in their vehicle during the time of the accident.
