70-Year-Old Dead from Hit-and-Run Crash

October 15, 2020 Alan Ahdoot

A hit-and-run incident was reported to have taken place in Bakersfield on Sunday, October 13th, 2020. California Highway Patrol was the first responder at the scene. They received information that the crash happened around 4:12 a.m., between the area of Mt. Vernon Avenue and Niles Street. The victim was later identified as a 70-year-old man named Aurelio Garcia Sr. He was pronounced dead at the scene. The driver of the unknown vehicle, a man named Joshua Reyes, who committed the hit-and-run, surrendered himself to Bakersfield Police Department a few hours afterward. He is currently under investigation by the relevant authorities.

Can You Still File A Claim Against A Hit-and-Run Driver Who Surrendered?

Yes, you can. But your option might be limited to only filing a claim against the driver or the driver’s auto insurance provider since if you have already filed a claim to your auto insurance, you cannot withdraw your claim if your insurance provider has already approved it. This kind of situation can put you in quite a conundrum – should you wait until a hit-and-run driver has been arrested before processing any bills incurred due to injuries or damages sustained from the crash?
