10-Year-Old Boy Dead from Three-Vehicle Crash
A three-vehicle crash was reported to occur on Wednesday, October 28th. California Highway Patrol was the first responder at the scene. The vehicles involved were two semitrailers and a passenger vehicle. The incident happened at Highway 99, near Rosedale Highway. One of the semitrailers failed to adhere to the traffic signs and crashed into the passenger vehicle.
The impact of the crash led the vehicle to crash headfirst into the back of the other semitrailer, which was driving in front of them. The passenger vehicle was occupied by two people, a woman, and a ten-year-old boy. The ten-year-old boy died at the scene and was later identified as a Bakersfield resident named Francisco Reyes-Ortiz. The woman, whose identity was not disclosed by the authorities, suffered from major injuries. Neither occupants of the semitrailer were reported to sustain any injuries.
Can A Driver File A Wrongful Death Suit on Behalf of a Dead Passenger?
Whether or not a driver can pursue a wrongful death claim on behalf of a dead passenger depends on whether the driver is related to the passenger. Wrongful death claims are usually done by the next living kin or the person who will be the beneficiary of the deceased’s estates. It is also possible for the driver to pursue a wrongful death claim on behalf of the deceased passenger if the family members have agreed to appoint the driver as their personal representatives at court.
