Pedestrian Dead After DUI Incident in East San Jose
A vehicular crash in East San Jose turned fatal after the vehicle hit a pedestrian on Friday, October 9th. San Jose Police Department is the lead investigator for the case. A 2004 Saturn L300 was traveling northward on South Jackson Avenue when the vehicle struck a male pedestrian. He was crossing the street outside of the crosswalk, according to eyewitnesses. He sustained severe injuries from the accident and although he was transported to the nearest hospital, he eventually died from his fatal wounds. The driver – who was also male – was found to have been driving under the influence of alcohol, and was arrested by the police.
Can You Pursue A Claim for DUI Accidents if At-Fault Driver Was Convicted?
Yes, you still can. Even if your at-fault driver was convicted of the DUI accident in which you were injured, you still can pursue a personal injury claim against them or their insurance provider. This is because the two cases will be treated in different courts – the DUI accident in criminal, your personal injury case in civil. Whether the criminal verdict will influence the civil verdict, however, depends entirely on the circumstances of the case.
