October 30, 2020 Alan Ahdoot

A homeless person was struck dead in a car accident on Monday, October 19th in Santa Clara. Santa Clara Police Department was the lead investigator in the case. The incident took place in a parking lot at El Camino Real and Halford Avenue, at around 4:30 p.m. The homeless person was a 74-year-old man, whose identity was not disclosed by authorities. He was sleeping in one of the parking areas when a 2019 Toyota Camry entered and struck the man. The driver did not notice that the man was lying in the parking area. The driver remained at the scene, and authorities have ruled out drug or alcohol influences. The same homeless person was involved in a similar incident on Sunday, October 18th, and had already sustained moderate injuries from the incident.

Are There Circumstances Where Wrongful Death Claims Cannot Be Filed on Behalf of the Deceased?

There are. It is not possible, for example, to file a wrongful death claim for the deceased when the statute of limitations on the car accident has already expired. In California, you have up to two years after a car accident to file a claim. It is also not possible to file a wrongful death claim on behalf of the deceased, when you are not related to them or are not the beneficiary of their estates. These are the common circumstances where wrongful death claims cannot be filed.
