Can You Claim Death Benefit from Insurance in DUI-Accident?

The answer to this depends on whether you are a drunk driver who died from the accident, or an innocent bystander who died from a drunk driver’s actions. A drunk driver who died due to a car accident, will usually not be able to claim death benefits from any of their insurance providers. This is because insurance companies would consider the death to be self-inflicted, thus violating the payout conditions. The bystander, however, can claim both payouts from their own insurance and the driver’s insurance companies. Nevertheless, whether your loved one was the driver or the bystander, you have the right to dispute decisions made by the insurance providers that you disagree with. If legal actions must be taken, you should contact an attorney right away. You can contact us to reach our legal counsel, available 24/7, by calling (866) 698-2306. Source: East Bay Times
