$200K Mediated Settlement for a T-Bone Collision

Our client was a rear-seat passenger of a vehicle traveling eastbound on Kittridge Street approaching the intersection of Wilbur Avenue in Los Angeles, California. At the same time, the defendant driver operating a vehicle was traveling northbound in lane #2 on Wilbur Avenue. The at-fault driver was approaching the intersection at a high rate of speed. Our client’s vehicle entered the intersection when the at-fault driver hit the side of our client’s vehicle. The t bone car wreck brutally struck the right passenger side.

Immediately after the collision, our client experienced hearing loss in their right ear. The police officer at the scene found the defendant driver at fault for the collision. The accused motorist was responsible for violating California Vehicle Code Section 21802 (a) V.C. for entering the highway from a stop sign, yield until reasonably safe.

The at-fault driver breached their statutory duty when they acted unreasonably, carelessly, recklessly, and negligently under the circumstances. In doing so, they forcibly caused this head-on collision. The defendant’s failure to keep a proper lookout for the condition of the roadway violated the statute. And, thereby, caused the t bone wreck.

Per the supportive documentation, our client was obeying all laws at the time of the crash and was acting reasonably under the circumstances, consequently alleviating any comparative negligence issues. Based on the foregoing, and based on the provided documentation, it is abundantly clear that liability solely rests with the at-fault driver. Liability is indisputable in this case.
