Our client was the driver of a vehicle with passengers. Specifically, our defendant had front-seat and rear-seat passengers. The car was traveling west on Dakota Avenue and was entering the parking lot of an apartment complex in Fresno, California when the car accident occurred. At that time, the defendant drove their vehicle into the parking lot with the intention of exiting to turn east onto Dakota Avenue.
The defendant failed to clear the westbound lane before continuing into the roadway and suddenly came into the path of our client’s vehicle. The plaintiff did not have time to react and collided with the defendant’s vehicle. As a result of this collision, our client’s vehicle was a complete loss.
Our defendant went to the emergency room at Community Regional Medical Center. There, they were examined for injuries sustained as a result of the automobile collision that occurred earlier that day. Our client complained of pain in the face, neck, arm, chest wall, and back. Physical examination demonstrated tenderness to palpation in the cervical spine and sternal chest.
