Our client was the driver and there was a front-seat passenger of a vehicle traveling northbound on Avalon Boulevard approaching the intersection of Del Amo Boulevard in Carson, California. At that time, the defendant driver was operating a vehicle directly behind our client’s vehicle at a high rate of speed. As our client slowed down and stopped for the red light at the intersection, the defendant failed to yield to the stationary traffic ahead and slammed into the rear of our client’s vehicle.
The force of the impact pushed our client’s vehicle into the rear of another vehicle in front. Upon impact, our client was jolted forward hitting the windshield, and jolted backward hitting the headrest of the car.
The police officer at the scene found the defendant at fault in violation of the California vehicle code 23152 (a) CVC for driving under the influence of alcohol and 22350 CVC for driving at an unsafe speed, and the defendant driver was arrested for driving under the influence of alcohol. As a result of this collision, our Client’s vehicle sustained extensive damage and the vehicle was totaled.
Our client went to the emergency department at Torrance Memorial Medical Center for evaluation and treatment of the injuries they sustained due to the motor vehicle collision that occurred earlier in the day. Our client complained of headache and pain in their neck.
