On Sunday, September 27th, a fatal incident was reported to have taken place in San Jose. A truck was traveling at an unknown road when it ran over a red light. The truck then struck a car that was driving past. The occupants of the vehicle, a driver and a passenger, died instantly from the crash. The driver is suspected to have been driving recklessly and is facing a manslaughter charge. The occupants of the vehicle were identified as Galdino Limon and Lourdes Garcia, parents of three children. They were driving to the laundromat when the accident occurred. The daughters are still in the fourth and sixth grades, studying in Russo/McEntee Academy and William Sheppard Middle School respectively. The victims also had a son, aged 19 years old. It is said that he planned to take custody of his siblings.

Is Wrongful Death Claims the Same As Personal Injury Claims?

No, it isn’t. If you were injured or suffered economic or non-economic damages due to the actions of another party, you can file a personal injury claim against them. Wrongful death claims, however, are usually filed by the next living kin of the deceased party against the person who is deemed to have caused the death of the deceased. You can claim damages on both claims, but the type of damages can differ. For example, in personal injury claims, you can file a claim for your medical bills or even lost wages. In wrongful death claims, you can file a claim for funeral costs as well as loss of financial support.
