Car Crashed into Tree, Killing Driver
On Saturday, September 26th, a solo vehicle crash occurred near Branham Lane, Sidlaw Court in San Jose. San Jose Police Department received information that the crash happened around 9 a.m. A man who was driving his 2005 Toyota Scion suddenly lost control of his vehicle and crashed into a closeby tree. He succumbed to his fatal injuries and died at the scene.
There were no other occupants in the car. Police are still investigating the identity of the driver and the cause of the incident.
Can Overgrown Trees Cause Single-Vehicle Crash?
Yes, they can. However, using this as a legal argument can be difficult. If you were involved in a single-vehicle crash and collided with a tree in the process, you have to be able to prove that the condition of the tree was the only factor of your incident and your negligence has little to no contribution. This can be difficult to prove if the police report says otherwise.
However, there are circumstances where you can use overgrown trees in a legal context. An example would be when a tree branch from a tree fell on your vehicle, causing you to lose control of your vehicle. In this situation, you can file a claim based on premise liability. With that said, if you need some help with your single-vehicle crash, an attorney is your best bet.
