Apple sued for AirPod hearing loss in child

A Texas couple is suing Apple for their son’s permanent hearing loss after using AirPods headphones. Carlos Gordoa and Ariani Reyes, the parents of a child identified as BG, are claiming more than $75,000 in damages from the headphone manufacturer.

According to BG’s parents’ lawsuit, the tech giant based is completely responsible for this severe negligence. “This is an action for personal injuries after defective AirPods worn by B.G. in his right ear produced ear-shattering sound levels that ripped open B.G.’s right eardrum and damaged his cochlea during an Amber Alert notification,” the complaint claims.

The minor was 12 years old when this incident occurred in 2020. The event happened when BG was watching Netflix in his car with his headphones on and an Amber Alert was issued. According to Reyes’ claim, her son has experienced “tinnitus, significant and permanent hearing loss, other temporary or permanent injuries, pain, suffering, and disabilities leading to the loss of the pleasures of life” as a result of the accident. According to BG’s mother, her son “was just a regular, healthy, athletic boy, and his life has changed” because of the irreparable hearing loss.

In addition to a damaged eardrum, the now 14-year-old is experiencing dizziness, vertigo, and nausea. The parents wanted to convey the devastating impact of the accident on BG through a video statement to the press. “We are very sad, frustrated, and a little bit angry,” they expressed, “since he will have to wear a hearing aid for the rest of his life.”

Apple might now be on the hook for future medical expenditures and BG’s possible reduced earning ability.

The California company has not yet commented on the incident.
