Our client, a pedestrian, was walking at a truck stop in Salinas, California, when they were hit by a commercial semi truck. One of the defendants was operating a vehicle in the same parking lot, while the other defendants included the driver’s employer and the truck stop where the accident occurred.
The defendant driver failed to notice our client due to poor visibility, making a sudden U-turn and striking them. The truck stop was also liable for turning off the floodlights at night, which contributed to the hazardous conditions. The impact threw our client to the ground, causing injuries to their face, hands, and knees.
They also suffered abrasions to their forehead and side. Additionally, they complained of pain in their right pelvis, back, and legs. They sustained lacerations to the left side of their face near the eye socket, forehead, bilateral arms, and right ankle. Our client also had bruising and abrasions along the left pelvic/hip region and left thigh, along with an open fracture to their right knee and possible injury to their right ankle.
Liability in this case was indisputable. The defendant driver’s failure to keep a proper lookout for the road conditions and surroundings violated statutes. And, it led to the collision. After being severely hit, the injured pedestrian was entitled to full compensation for all economic and non-economic damages caused by this semi truck accident.
