A sexual abuse lawsuit is a legal action that allows survivors to hold their abuser accountable for the physical, emotional, and psychological harm they have suffered. Any form of sexual misconduct can be grounds for an injury lawsuit. These legal claims seek not only justice but also financial compensation to help mitigate the lasting impact of the abuse.

In California, there are two legal paths: criminal and civil. As explained below, the deadline to file a claim depends on several factors. However, recent legislation, such as the Adult Survivors Act, has significantly extended the time survivors have to pursue justice.

When it comes to the statute of limitations, the time available to file a lawsuit primarily depends on the victim’s age at the time of the abuse and when the resulting harm was discovered. If the survivor was over the age of 18 when the abuse occurred, they have up to 10 years from the date of the incident to file a claim. They may also file within three years from the time they became aware of the injuries caused by the abuse. If the abuse happened when the victim was a minor, they can sue until they turn 40, or within five years after recognizing the physical or emotional damage caused by the abuse.

Differences Between Criminal and Civil Sexual Abuse Lawsuits

In criminal sexual abuse cases, the primary goal is to punish the offender. The State, through the prosecutor, files charges against the accused. A criminal court then determines guilt or innocence and, if the accused is found guilty, may impose a sentence. To secure a criminal conviction, the prosecution must prove the facts beyond a reasonable doubt.

In civil cases, however, the victim files a lawsuit seeking financial compensation for the physical, psychological, and emotional harm caused by the abuse. Unlike criminal proceedings, civil courts do not aim to punish the offender but rather to establish their liability for damages.

The burden of proof in civil cases is lower than in criminal cases. Rather than proving guilt “beyond a reasonable doubt,” the plaintiff only needs to show that it is more likely than not that the abuse occurred as described, a standard known as “preponderance of the evidence.”

Additionally, if the abuser committed the abuse while acting in a position of responsibility within an institution—such as a school, church, or sports organization—that entity may also be held liable. Victims can sue the employer for negligence, especially if the institution failed to take adequate steps to protect the public or concealed the abuse.

Sexual Assault Settlement Amounts: What Compensation Can Victims Receive?

If you file a civil claim for sexual abuse against your abuser, you may be entitled to compensation for pain, suffering, and emotional distress. This compensation may also cover medical expenses, therapy, counseling, and other mental health care costs.

What Factors Determine Compensation Amounts?

Regarding sexual assault damages awards, the compensation or settlement amount varies depending on the specifics of your case. The following factors are often considered when calculating sexual abuse compensation:

  • The Severity of the Abuse: A more severe case can win you maximum compensation.
  • The Effect on Your Life and Well-Being: Do you experience physical or emotional pain and suffering? Are you unable to earn income since the incident?
  • The Location for Your Claim Filing: Depending on your location and the sexual abuse-related statutes it enforces, your settlement may be higher or lower.
  • The Abuser’s Ability to Pay Compensation: Big firms or wealthy perpetrators may award you more money to compensate for the abuse.

Recent Media Cases of Sexual Abuse Lawsuits

To illustrate how victims of sexual crimes can seek justice through civil lawsuits, we will analyze two recent, high-profile cases that captured national attention and set important precedents regarding financial compensation for damages suffered.

These cases are notable not only because they involve well-known public figures, but also because of the severity of the allegations and the substantial damages claimed by the victims.

Diddy and Sharpee, accused of sexual abuse and assault, seated at two different events.

Sean “Diddy” Combs and Cassie Ventura

After nearly a decade together, singer Cassie Ventura publicly accused her former partner, music producer Sean Combs, of multiple sexual offenses. In November 2023, she filed a civil lawsuit against Combs under the Adult Survivors Act, alleging sexual assault, intimidation, and physical violence.

Remarkably, the case was settled in less than 24 hours for $20 million. Cassie also received compensation from the InterContinental Hotel, which was accused of enabling and covering up some of Combs’ abusive acts on its premises. This additional award is estimated at $10 million.

This case marked a turning point. Since then, Combs has been arrested and is under federal investigation. He currently faces at least 66 active civil lawsuits related to sexual offenses, with total claims exceeding $55 million.

Shannon Sharpe

In April 2025, another case involving a public figure came to light. A woman filed a civil lawsuit against Shannon Sharpe, former NFL player and sportscaster, accusing him of sexual misconduct, sexual assault, and severe emotional harm.

The complaint detailed allegations of rape, non-consensual recordings, physical violence, threats, and psychological control during their relationship, which began in 2023. The victim described a persistent pattern of physical and emotional abuse, resulting in serious psychological trauma.

In July 2025, both parties reached a confidential out-of-court settlement to avoid trial. Although the amount of the sexual assault settlement has not been officially disclosed, estimates suggest that the victim could receive between $10 million and $50 million.
