Our client stopped by for morning groceries at Ara’z International Market in Granada Hills, CA. As our client took a box of butter out of the fridge, they turned with the intention to walk towards the nearby cash register, and slipped on something greasy on the floor, falling down and twisting their right foot. These slip and fall injuries resulted in a claim represented by our law firm.
Our client was quite familiar with the store, having visited on several prior occasions. At the time of our client’s fall, there were no caution signs, cones, or any other marking indicating there might be some dangerous condition on the floor, except for one small plaque-like warning to “watch your stop” that was kept at all times, affixed to the refrigerator. At the time of the fall, therefore, there was nothing out-of-the-ordinary or unlike during any of the prior visits to the store, putting Plaintiff on notice regarding any potential spill and/or other dangerous conditions on the floor.
Furthermore, there is only one mat in the entry-exit pathway of the store, right at its doors. Per the deposition testimony, the store owner decided to place only that one mat because it might get slippery or hazardous, especially with foot traffic or if it rains outside. There are no mats anywhere else in the store despite there being multiple refrigerators inside the store. Our experienced slip and fall lawyers won a $150K personal injury claim.
