In Bolger v. Amazon.com, LLC, the California Fourth District Court of Appeals found that Amazon could be held liable for damages arising from a defective battery in a laptop computer. The lawsuit arose after a woman bought a replacement laptop battery on Amazon, which exploded, causing severe burns. The victim, Angela Bolger, sued Amazon alleging strict products liability, negligent products liability, breach of implied warranty, breach of express warranty, and “negligence/negligent undertaking.” The battery manufacturer, Lenoge Technology (HK) Ltd was a party to the suit but did not appear, so default judgment was entered against them.
One of the points of the case was Amazon’s self-imposed placement in the chain of distribution of the product. Amazon controlled Lenoge’s access to customer information, and forced Lenoge to communicate with customers through Amazon, while demanding indemnification and receiving substantial fees on purchases.
